Arbitration is a legal procedure in which contracting parties voluntarily establish their own private tribunal to resolve disputes arising from the contract in a confidential manner. Courts in over 160 countries and states recognise and enforce the orders and awards of arbitration tribunals. However, arbitration can also be very costly, with the expenses for each arbitration hearing reaching as high as HK$1-3.5 million or even more.

​Mediation is a process where the disputing parties voluntarily hire a mediator to resolve their dispute. Mediators are primarily litigation lawyers whose role is to professionally facilitate an amicable resolution between the parties. However, the mediator does not make any ruling on the dispute. The mediation process is confidential; if mediation fails, the parties may not disclose any settlement proposal or related content from the mediation meetings to the court as evidence. Mediation is relatively inexpensive, with the cost of each mediation session (including the attendance of the mediator and the parties' own lawyers for six hours) being approximately HK$30,000 to HK$40,000.
